ORDINANCE NO. 347

AN ORDINANCE TO PROVIDE FOR THE IMPOSITION OF ATTORNEY'S FEES, COSTS AND DISBURSEMENTS IN CIVIL COURT PROCEEDINGS BROUGHT BY THE CITY TO ENFORCE REQUIREMENTS OR PROHIBITIONS OF CITY ORDINANCES OR RESOLUTIONS; TO PROVIDE A LIEN AGAINST PROPERTY TO SECURE PAYMENT; AND DECLARING AN EMERGENCY.

The City of Yamhill ordains as follows:


Section 1. Whenever the city maintains a civil action or suit to enforce any requirements or prohibitions of a city ordinance or resolution the city is authorized to recover attorney's fees, costs and disbursements necessarily incurred in such action or suit or appeal thereof as allowed by the Court. Such attorney's fees, costs and, disbursements shall constitute a lien, valid and subsisting upon the real property or personal property which is the subject of, or in any way connected with, the suit or action or owned by the defendants.

Section 2. The Council desires and deems it necessary for the preservation of the health, peace, and safety of the City of Yamhill, that this Ordinance take effect at once; and, therefore, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after the date of its passage and approval.
