AN ORDINANCE AMENDING
SECTION 21, A PORTION OF SECTION 26 AND SECTION 32 OF ORDINANCE NO. 210, INITIATIVE
AND REFERENDUM, AS AMENDED BY 301 AS PASSED BY THE CITY COUNCIL, CITY OF YAMHILL,
OREGON; AND DECLARING AN EMERGENCY.
The city of Yamhill ordains
as follows:
Section 1. Amendment
of Section 21. Section 21 of Ordinance No. 210 as amended by Ordinance No. 301
is amended to read as follows:
"Section 21. Time to Vote
on Measure. The time for voting on a measure required to be submitted to the
voters shall be the first regular election held more than 89 days after the
verification and filing of a duly prepared petition by the recorder. A measure
required by State Law or the City Charter to be submitted to the voters shall
be the first general election held morel than 60 days after the verification
and filing of a duly prepared petition by the recorder.
Section 2. Amendment
of Section 26, Subparagraph (2), of Ordinance No. 210 as amended by Ordinance
301 is amended to read as follows:
Section 26. Election Returns, subparagraph (2)
(2) In case of regular
elections, in the manner provided by the city charter and ordinances, and in
accordance with state law.
Section 3. Amendment
of Section 32. Section 32 of Ordinance No. 210 as amended by Ordinance No. 301
is amended to read as follows:
Section 32. Penalty. A person who violates a provision of this ordinance shall be punished by:
(1) A fine of not more than $750.00, or
(2) Imprisonment in jail not more than 30 days, or
(3) Both.
Section 4. Emergency
Clause. The Council desires and deems it necessary for the preservation of the
health, peace and safety of the City of Yamhill that this ordinance take effect
at once, and therefore, an emergency is hereby declared to exist, and this ordinance
shall be in full force and effect from and after its passage and approval.
