AN ORDINANCE ESTABLISHING
THE OFFICE OF RECORDER/CITY ADMINISTRATOR FOR THE CITY OF YAMHILL, OREGON; AUTHORIZING
THE APPOINTMENT OF CITY ADMINISTRATOR AND PRESCRIBING THE DUTIES AND CONDITIONS
UNDER WHICH HE OR SHE WILL SERVE.
The City of Yamhill ordains
as follows:
Section 1. Creation of Office
and Term Of Office. The Office of City Administrator is hereby created. The
Mayor Shall appoint the City Administrator, with the majority vote of the City
Council. The appointment shall be for an indefinite term, but the City Administrator
may at any time be removed by the Mayor, with consent of the City Council, and
the action of the Council in removing the City Administrator shall be final.
Section 2. Powers and Duties.
The powers and duties of the City Administrator shall be the following:
(A) Plans, directs and
reviews the work of the department heads, supervises all city employees consistent
with the chain of command and personnel policies of the city.
(B) Whenever necessary
to fill vacancies in administrative positions that are required by law or Charter
to be appointments of the Mayor and City Council, the City Administrator shall
submit the names of qualified individuals for approval by the Mayor and City
Council. No appointment or dismissal to an administrative office shall be made
without the City Administrators views having been considered. The City Administrator
may recommend disciplinary action of any such appointee when it would be in
the best interest of the City, and the governing body shall fully consider the
City Administrator's recommendations. All recommendations for appointment or
removal shall be based solely on the merit, qualifications, or disqualifications
of the employee concerned without regard to his political beliefs or affiliations.
(C) Supervises and works
with the preparation of the annual budget; reviews and approves departmental
needs and estimates and transmits budget to Budget Committee for review and
final action.
(D) Works and supervises
the receipt and disbursement of monies and investments of city funds; directs
daily budgetary affairs and administration. Serves as chief purchasing and business
agent of the city, making all purchases under $500.00; meets with vendors, contractors,
salesmen and consultants and is responsible for the efficient expenditure of
city funds.
(E) Meets with the City
Council in regular and special meetings, gives information and transmits special
or regular reports covering varied problems of municipal operations and advises
council members in the deliberations on policy or legislative matters.
(F) Attends Planning Commission
meetings; process applications for staff review, comprehensive plan and ordinance
revisions and interpretation and development; assist in the processing of variance,
partitions and land use permits; have knowledge of and enforce the zoning laws
for the city.
(G) Meets with private
citizens seeking information on city organization, zoning, budget, development
and other issues of city concern.
(H) Meets with representatives
of various governmental agencies on varied problems involved in the coordination
of city services with those of other governmental units, the negotiation of
agreements, disposition of complaints and matters.
(I) Attends meetings as
a representative of the municipal government and prepares and delivers speeches.
(J) Confers with department
heads and others on varied operating and administrative problems; reviews department
plans, programs and procedures; and suggests new innovations or methods to improve
the standard of services rendered by the city.
(K) Conducts correspondence
on varied public contact problems and prepares or supervises the preparations
of informative materials for publication.
(L) The City Administrator
will serve as City Elections Officer, as prescribed by State Law.
(M) The City Administrator
will not enter into contractual agreements without approval of the Mayor and
City Council.
The City Administrator
will perform such other duties as may be required by the Mayor and City Council,
not inconsistent with the City Charter, any City Law or Ordinance.
Section 3. Compensation
and Bonding. The City Council shall set the compensation and bonding of the
City Administrator.
Section 4. Repeal. All ordinances or parts of ordinances dealing with establishing and authorizing the appointment of the City Administrator that are in conflict herewith are hereby repealed.
