ORDINANCE NO. O-411

AN ORDINANCE OF THE CITY OF YAMHILL, PERTAINING TO THE ADOPTION OF STANDARD SPECIFICATIONS FOR PUBLIC WORKS CONSTRUCTION.

WHEREAS, the City Council deems it necessary to adopt standard specifications for Public Works Construction; and

WHEREAS, the City has decided to follow the standards established by the American Public Works Association, Oregon Chapter; now, therefore,

THE CITY OF YAMHILL ORDAINS AS FOLLOWS:

Section 1. Definitions:

(a) "Contractor" shall refer to the person, persons, or firm responsible for the construction, reconstruction, repair, and maintenance of the improvements.

(b) "Owner" shall refer to the City of Yamhill.

Section 2. Code Adopted:

Except as otherwise provided by written contract with the City or by supplemental specifications and plans authorized and maintained by the City Engineer, and Public Works Department, all public improvements, all private improvements located within or affecting City rights-of-way or easements, and all improvements affecting City-owned utilities shall be constructed, reconstructed, repaired, and maintained in accordance with the 1990 Standard Specifications for Public Works Construction manual published by the American Public Works Association, Oregon Chapter.

Section 3. Exceptions and Additions:

Exceptions and additions to the plans and specifications contained in the manual may be authorized or required by the City Engineer and/or Public Works Department. With regard to a particular project or class of project, the City Engineer and/or Public Works Department may disapprove any specification or material otherwise permitted if, in the City's opinion, the use of the specification or material would not be suitable or would not conform with highest standards of safety, engineering, and construction practice.

Section 4. Repealer. This Ordinance repeals any previous ordinance(s) on same subject.
