AN ORDINANCE OF
THE CITY OF YAMHILL, AMENDING CITY ORDINANCE NUMBER 371, PROVIDING RULES AND
REGULATIONS FOR THE OPERATION OF THE SEWER DEPARTMENT OF THE CITY OF YAMHILL.
WHEREAS,
the Yamhill City Council deems it necessary to review and occasionally update
the current Rules and Regulations for the Operation of the Sewer Department;
and
WHEREAS,
the City Council has determined it would benefit the citizens of the City of
Yamhill if the Sewer Account Deposits were retained for a longer period of time,
NOW THEREFORE,
THE CITY OF YAMHILL
ORDAINS AS FOLLOWS:
SECTION 1.
Ordinance #371, Section "11.3.2 Deposits" shall be amended to read as follows:
11.3.2 Deposits. At the time the deposit is given to the Sewer Department, the applicant will be given a receipt for the same. The deposit is not to be considered as a payment on account. The deposit will be returned to the customer when service to the customer is discontinued, provided all outstanding bills have been paid. The Sewer Department may, at its option, return the deposit upon application, provided the following conditions have been met:
a. All bills have been
paid promptly for twelve (12) consecutive billing periods immediately preceding
the request for deposit refund;
b. The City shall retain
the deposit for a minimum of 60 months prior to accepting any applications for
deposit refund.
The Sewer Department will
not pay interest on any deposit.
SECTION 2.
All remaining provisions of Ordinance Number 371 are hereby reaffirmed in their
entirety.
