AN ORDINANCE OF
THE CITY OF YAMHILL, PERTAINING TO THE ESTABLISHMENT OF CITY RULES, IN ACCORDANCE
WITH CHARTER CHAPTER IV, SECTION 13, MAY ALSO BE KNOWN AS THE COUNCIL RULES
ORDINANCE.
WHEREAS,
the current City Charter, Chapter IV, Section 13, states that the Council shall
adopt rules for the government of its members and proceedings; and
WHEREAS,
the current City Recorder/Treasurer is attempting to reorganize City Hall to
abide by all Charter requirements; and
WHEREAS,
the Council has reviewed and approved suggested Council Rules; NOW THEREFORE
THE CITY OF YAMHILL
ORDAINS AS FOLLOWS:
Section 1 Regular meeting
date and time. The council shall hold its regular meetings on the second
and fourth Wednesday of each month beginning at seven p.m. local time, except
when said day falls on a legal holiday, in which event the council shall meet
at the same hour on the following day. Regular meetings may be canceled by the
council if done at an earlier regularly scheduled meeting; however, council
must meet at least once each month.
Section 2 Meeting place.
The council shall meet at the Community Center unless its members determine
another location for a special purpose meeting. All meetings of the council
shall be open to the public. The minutes of council meetings shall be kept in
a book to be known as the journal which shall be a public record.
Section 3 Notice of meeting
and agenda. The council shall cause to be posted at the door of City Hall
and the Community Center, at least twenty-four hours before each regular meeting,
a notice of the place, date, and hour of such meeting. The notice shall also
include a list of the principal subjects anticipated to be considered at the
meeting, but this requirement shall not limit the ability of a governing body
to consider additional subjects.
Section 4 Special meetings.
In accordance with City Charter, Chapter IV, Section 13, the Mayor upon his
own motion may, or at the request of two members of the council shall, by giving
notice thereof to all members of the Council then in the City, call a Special
Meeting of the Council for a time not earlier than three nor later than forty-eight
hours after the notice is given. Special meetings of the Council may also be
held at any time by the common consent of all the members of the Council.
Section 5 Recessed meetings.
At any regular meeting, the council may recess to a specified time thereafter,
and the recessed meeting shall be deemed a regular meeting at which all business
shown on the agenda for the regular meeting may be transacted in the same manner
and with the same force and effect as at a regular meeting held at the time
appointed by the ordinance in this chapter.
Section 6 Legislative
business. In the transaction of legislative business, the council shall
act only by ordinance. The ayes and nays shall be recorded upon each ordinance
and entered in the journal.
Section 7 Administrative
business. In the transaction of administrative business, the council may
act by ordinance, resolution or motion. The ayes and nays shall be recorded
for each ordinance or resolution and entered in the journal.
Section 8 Order of business.
The minutes of the last regular meeting and the minutes of recessed or special
meetings, if any, shall be read at each regular meeting before proceeding with
other business. The order of business shall be determined by the mayor and/or
city recorder/treasurer.
Section 9 Parliamentary
procedure. All parliamentary questions which may arise before the council,
which are not otherwise provided for, shall be determined by Robert's Rules
of Order, Newly Revised.
Section 10 Selection
of president. At its first regular meeting of every odd numbered year, the
council shall elect, by a majority vote, a president from its members. In the
Mayor's absence or disability, the president shall perform the duties of mayor.
In the absence of both the mayor and president, the other members of the council
shall select one of their number to perform the duties of president during such
absence.
Section 11 Meetings--Citizen
comment. Citizen comments will be scheduled for all council meetings that
are open to the public.
Section 12 Meetings--Ground
rules. The mayor will state the ground rules at the beginning of each meeting.
The mayor will announce how and when citizens can comment on specific agenda
items.
Section 13 Meetings--Addressing
the council. A person who wishes to address the council shall indicate that
they wish to do so in a reasonable manner which is not disruptive to the meeting.
A person shall raise his/her hand or indicate on a sign-in sheet, if one is
available, that they wish to address the council. If a person is not physically
able to raise their hand or sign in, they may indicate to the council in some
other manner that they wish to be recognized. Once recognized by the council,
the person shall provide their name and address for the record and shall limit
their testimony or presentation to two to five minutes at the discretion of
the presiding officer.
Section 14 Meetings--Authority
of presiding officer. The presiding officer has the authority to preserve
order at all meetings of the council, to cause the removal of any person from
any meeting for disorderly conduct and to enforce the rules of the council.
The presiding officer may command the assistance of any peace officer of the
city to enforce all lawful orders of the presiding officer to restore order
at any meeting.
Section 15 Public hearing
procedures. At public hearings the mayor will state the public hearing procedures
before each hearing.
