ORDINANCE NO. 460
AN ORDINANCE FIXING THE TIME AND PLACE FOR A PUBLIC HEARING BEFORE THE COUNCIL OF THE CITY OF YAMHILL, OREGON, AT WHICH TIME THE REGISTERED VOTERS AND OTHER INTERESTED PERSONS MAY APPEAR AND BE HEARD ON THE QUESTION OF ANNEXATION TO THE CITY OF CERTAIN AREA AND TERRITORY THE AREA DESCRIBED HEREIN, AND DECLARING AN EMERGENCY.
R E C I T A L S:
WHEREAS, Franklin A. Eckrode Sr. is the owner of the tract of land described below in this ordinance, and has petitioned and desires that said property be annexed to the City of Yamhill, Oregon; and
WHEREAS, the area and territory described below is contiguous to the City of Yamhill, Oregon; and
WHEREAS, it is the determination of the Council of the City of Yamhill, Oregon, that a public hearing be held to consider whether said area and territory herein below described be annexed to the City of Yamhill, Oregon; and
WHEREAS, the Council of the City of Yamhill elects to dispense with submitting the question of annexation of said area and territory to the registered voters of the City of Yamhill, Oregon, upon the question of the annexation of said area and territory as provided by Section 222.120, Oregon Revised Statutes;
NOW THEREFORE THE CITY OF YAMHILL DOES ORDAIN AS FOLLOWS:
Section One. That the City Council of the City of Yamhill, Oregon, does hereby call, fix and order a public hearing to be held before the Council of the City of Yamhill, Oregon, in the Council Chambers at City Hall, Yamhill, Oregon, at the hour of 6:00 p.m. On the 24th day of October, 2001, at which time the residents of the City may appear and be heard on the question of the annexation of such territory and area to the City, which area and territory is described as follows to-wit:
A portion of the East 2 of Section 4, together with a portion of the West 2 of Section 3, Township 3 South, Range 4 West, Willamette Meridian, County of Yamhill, State of Oregon, being more particularly described as follows:
Beginning at the Intersection of the Southerly Right of Way Line of E. Third Street with the West line of the Eckrode Tract of Land as described in deed, recorded in Film Volume 258, Page 1993, Deed Records of Yamhill County, said Point of Beginning bears West, 412.50 feet and S0016=21@W, 564.31 feet from the Brass Disk marking the Southeast Corner of the A. Job D.L.C.; thence along the Easterly Extension of the South Line of E. Third Street, S8958=35@E, 170.00 feet; thence leaving said line, S0016=21@W, 179.44 feet to the South line of said Eckrode Tract of Land; thence along said line, S8959=59@W, 170.00 feet to the Southwest Corner thereof; thence along the West line of said Tract of Land, N0016=21@E, 179.51 feet to the point of beginning.
Containing 0.700 Acres.
Section Two. That the Recorder of the City of Yamhill, Oregon, is hereby to cause notice of said hearing to be published once each week for two successive weeks prior to the date of said hearing in the News-Register, a newspaper of general circulation in the City of Yamhill, Oregon, and to cause notices of such public hearing to be posted in four public places in the City of Yamhill, Oregon, for a period of at least two weeks prior to said public hearing, and such notice shall declare the territory and area proposed to be annexed to the City of Yamhill, Oregon, and residents of the City of Yamhill shall be invited to appear at said public hearing and be heard on the question of such proposed withdrawal.
Section 3. Emergency Clause. The City Council desires and deems it necessary for the preservation of the health, peace and safety of the City of Yamhill that this ordinance take effect at once, and therefore an emergency is hereby declared, and this ordinance shall be in full force and effect from and after its passage and approval.
