ORDINANCE NO. O-473

AN ORDINANCE AMENDING TITLE 2, STANDARD SPECIFICATIONS FOR PUBLIC WORKS, OF THE YAMHILL MUNICIPAL CODE.

WHEREAS, the Yamhill City Council recognized the need to keep City standards current with the needs of the Yamhill Rural Fire Department standards for emergency response vehicles, changes are necessary; NOW THEREFORE;

THE CITY OF YAMHILL ORDAINS AS FOLLOWS:

SECTION 1.   Yamhill Municipal Code Chapter 2.24, Standard Specifications for Public Works, is hereby amended to read as follows:

   STANDARD SPECIFICATIONS FOR PUBLIC WORKS

2.24.010 Definitions:

"Contractor" shall refer to the person, persons, or firm responsible for the construction, reconstruction, repair, and maintenance of the improvements.

"Owner" shall refer to the City of Yamhill. (Ord. O-411, '1, 1996)

2.24.020 Code Adopted. Except as otherwise provided by written contract with the City or by supplemental specifications and plans authorized and maintained by the City Engineer, and Public Works Department, all public improvements, all private improvements located within or affecting City rights-of-way or easements, and all improvements affecting City-owned utilities shall be constructed, reconstructed, repaired, and maintained in accordance with the 2003 Standard Specifications for Public Works Construction manual and drawings published by the American Public Works Association, Oregon Chapter in conjunction with Oregon Department of Transportation and 2004 Oregon Uniform Fire Code, Chapter 5, Sections 501 through 508; Appendix B, Appendix C and Appendix D in conjunction with the 2003 International Fire Code. 2.24.030 Exceptions and Additions. Exceptions and additions to the plans and specifications contained in the manual may be authorized or required by the City Engineer and/or Public Works Department. With regard to a particular project or class of project, the City Engineer and/or Public Works Department may disapprove any specification or material otherwise permitted if, in the City's opinion, the use of the specification or material would not be suitable or would not conform with highest standards of safety, engineering, and construction practice. SECTION 2.   This Ordinance hereby amends Yamhill Municipal Code Chapter 2.24, Standard Specifications for Public Works. All remaining portions of Yamhill Municipal Code, Title 2, Local Improvements, are hereby reaffirmed in their entirety.
